Brett Rosenau perished when a mattress he was sleeping on caught fire from one of the canisters. In a statement released on Friday, Balderas said, “The unfortunate death of (Rosenau) was avoidable and it appears that less-lethal tactics to detain the suspect earlier would have mitigated fatal risks.“
As Rosenau’s attorney, Taylor Smith, put it, What we’ve known to be true since this happened is confirmed by Balderas’ findings: Rosenau’s death was preventable. One of several Bernalillo County deputies assisting the APD Swat team threw the canister that started the fire.
The fire department in Albuquerque, New Mexico concluded that it was an accident and blamed the authorities.
